1. Agreement
By downloading, installing, or using Capio, you agree to these Terms of Service. If you do not agree, do not use the app. These terms form a legal agreement between you and the Capio developer.
2. What Capio Is
Capio is a premium planner application designed for personal and professional productivity. It is available on iPad and iPhone, and requires an Apple Pencil for the full handwriting experience on iPad. Capio is intended for users aged 18 and older.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Capio on devices you own or control, for your personal, non-commercial use, subject to these terms.
You may not:
- Copy, modify, or distribute the app or its content
- Reverse engineer or attempt to extract the source code
- Use the app to build a competing product
- Remove any copyright or proprietary notices
- Use the app for any unlawful purpose
4. Account & Apple ID
Capio uses Apple ID for authentication. You are responsible for maintaining the security of your Apple ID. Any activity under your Apple ID is your responsibility. Capio is not responsible for unauthorized access to your account resulting from your failure to secure your Apple ID.
Your subscription is tied to your Apple ID. Capio cannot transfer subscriptions between Apple IDs.
5. Free Trial
Capio offers a 7-day free trial with full access to all features. The trial begins when you create your first planner. No Apple ID or payment is required during the trial period.
When the trial ends, you must sign in with Apple ID and subscribe to continue using the app. Your data from the trial period is preserved and will be accessible upon subscribing.
6. Subscriptions & Payment
Pricing: Monthly: $14.99/month. Annual: $119.99/year.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
Stripe (web checkout): Subscriptions purchased via capioplan.com are processed by Stripe and governed by Stripe's terms. You may manage or cancel your subscription at capioplan.com or by contacting vee@capioplan.com.
Apple In-App Purchase: Subscriptions purchased through the App Store are governed by Apple's terms of service. You may manage or cancel via Settings → Your Name → Subscriptions.
7. Refunds
Stripe subscriptions: Contact vee@capioplan.com within 14 days of charge for refund consideration. Refunds are granted at our discretion.
Apple IAP subscriptions: Refunds are handled by Apple. Contact Apple Support or visit reportaproblem.apple.com.
We do not offer refunds for partial subscription periods or for failure to use the app during an active subscription period.
8. Your Data
You own all content you create in Capio — your tasks, notes, plans, and handwriting. We do not claim any ownership of your planning data.
You are responsible for maintaining your own backups. Capio's local-first architecture means data loss from device failure, accidental deletion, or app removal is possible and may be unrecoverable without a backup.
We strongly recommend enabling iCloud Sync to protect your data.
9. Acceptable Use
You agree not to use Capio in any way that:
- Violates any applicable law or regulation
- Infringes the intellectual property rights of any third party
- Transmits harmful, offensive, or malicious content
- Attempts to gain unauthorized access to any system
- Interferes with the proper functioning of the app
10. Intellectual Property
Capio, its logo, design, code, and all content created by us are owned by the Capio developer and protected by copyright, trademark, and other intellectual property laws. "Write once. It's handled.", "Write. Set. Go.", and "Capio" are used exclusively by this product.
Nothing in these terms transfers any intellectual property rights to you beyond the limited license described in Section 3.
11. Disclaimers
Capio is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, that the app is free of viruses or harmful components, or that the app will meet your specific requirements.
Use of Capio is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, the Capio developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of business — arising from your use of or inability to use Capio, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms or your use of the app shall not exceed the amount you paid for your Capio subscription in the 12 months preceding the claim.
13. Termination
We may suspend or terminate your access to Capio at any time if you violate these terms. You may stop using Capio at any time by deleting the app.
Upon termination, your license to use Capio ends immediately. Local data on your device is not automatically deleted when your access is terminated — you may retain it on your device but will be unable to use the app.
14. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via an in-app notice before the changes take effect. Continued use of Capio after changes take effect constitutes acceptance of the revised terms.
15. Governing Law
These terms are governed by the laws of the jurisdiction in which the Capio developer operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
